Myotest SA. ("Myotest," "we," "us") provides this Privacy Policy to inform you regarding the collection, use and disclosure of personal data that we receive from you when you visit and use the Myotest website located at www.myotest.com and Myotest applications on Devices and through APIs, including the Myotest Pro Running Service,  (collectively, the "Site"). Please note that this Privacy Policy only applies to this Site. This Privacy Policy was last updated on March 03, 2017 and may be modified from time to time for any reason. We will notify you of any material changes to our Privacy Policy, for example, by posting the new Privacy Policy on our Site. You are advised to consult this Privacy Policy regularly for any changes.

Information You Provide

You may visit the Site without registering or actively submitting personal data to us. If you do not register, then we receive only information that your computer or other device sends to us in connection with access requests and via cookies and other technologies that we use to analyze and enhance your use of our Site.

There are certain services we offer, however, which require the submission of personally identifiable information, such as your first name, last name, email address and phone number. "Personal Data" is information that can be used, directly or indirectly, alone or together with other information, to identify you as an individual.  If you contact us by email through the Site, we may keep a record of your contact information and correspondence, and may use your email address, and any information that you provide to us in your message, to respond to you. We also use your Personal Data to send you other publications or information about our products that may be of interest to you. In addition, we may send you important administrative information regarding the Site and/or services we offer via the Site. If you decide at any time that you no longer wish to receive communications from us, please send an email to privacy@myotest.com to unsubscribe or opt-out.

If you purchase services or register for an event, we may also require you to provide with credit card and billing information, such as billing name and address.

Account creation and billing

When you register an account, we may collect some Personal Data, such as your name, phone number, credit card or other billing information, email address and home and business postal addresses. For credit cards, although this information transits through our servers, we do not store or archive credit card numbers or CCV2 information. This information is transferred to the credit card processor.

Non-Personal Information

To provide the Site services, we collect non-personally identifiable information ("Log Data") that help improve the accuracy and reliability of the services provided by the Site.

This Log Data may include anthropometric data and running parameters, such as step count, speed, distance, cadence, more advanced biomechanics, as well as birth date and age, gender, height, leg length, weight, training level (kilometer or miles per week, prior to using the service) and geo-location (real-time location-based information, such as, GPS).

Generally, we do not consider Log Data to be Personal Data. Regardless, if we link together Log Data in a way that renders it individually identifiable, we will treat the combined information as Personal Data.

Tracking Technologies

When you visit the Site, our servers automatically record information that your browser sends whenever you visit a website (also "Log Data"). This information may include information such as your IP address, browser type or the domain from which you are visiting as Internet domain and host names; operating system types; clickstream patterns; and dates and times that our site is accessed. For most users accessing the Internet from an Internet service provider, the IP address will be different every time you log on. We use it to monitor use of the Site and the services we offer via the Site and for the Site's technical administration.

Like many websites, we also use "cookie" technology to collect additional website usage data and to improve the Site and the services we offer via the Site. A cookie is a small data file that we transfer to your computer's hard disk. We do not use cookies to collect names or contact information. However, IP addresses are collected by the use of cookies. We mainly use "session cookies", which enable certain features of the Site and services we offer via the Site, to better understand how you interact with the Site and services we offer via the Site, to monitor aggregate usage by our users and web traffic routing on the Site, and to improve the Site and services we offer via the Site. This session cookie is deleted from your computer when you disconnect from or leave the Site. Most Internet browsers automatically accept cookies. You can instruct your browser, by editing its options, to stop accepting cookies or to prompt you before accepting a cookie from the websites you visit.

We do not recognize or take action in response to Do-Not-Track (DNT) signals from Web browsers. At this time there is not any universally accepted standard for a company's adoption for how to respond when a DNT signal is detected. In the event a final standard is established, we will determine how to appropriately respond to these signals.

Other Information You Choose Provide

An optional feature of the services provided by the Site is to share results and other performance information with friends or co-runners, which may contain user entered text. As such, we collect this information for the purpose of distributing it to the other users you choose to share it with. It is your responsibility to make sure you have the rights to publish all personal information you share, including those of third parties.

How We Use Personal Data

We use your Personal Data and Log Data to operate, evaluate and improve our Site and business (including developing new products and services; enhancing and improving our services; managing our communications; and analyzing our products) and to communicate with you and respond to your requests. Personal Data may also be used to personalize and improve your experience. If you use the services offered by the Site, we will use your Personal Data and Log Data to provide the services to you.

Sharing of Personal Data

We disclose your Personal Data only as follows:

  • With your consent.
  • We use affiliated and unaffiliated service providers all over the world that help us deliver our services and run our business subject to confidentiality agreements.
  • We share aggregated usage statistics that cannot be used to identify you individually.
  • We will disclose data as required by law or to protect you, other users, us or third parties from harm, including fraud, data security breaches or where someone's physical safety seems at risk.
  • In a reorganization or sale of our company or assets, your data may be transferred, subject to the acquirer accepting the commitments made in this Privacy Policy and compliance with applicable law.

    Our Site may offer publicly accessible community services such as blogs and forums. You should be aware that any information you provide in these areas may be read, collected, and used by others who access them. Your posts may remain even after you cancel your account.

    Data Security

    Myotest employs administrative, physical and electronic measures designed to protect your information from unauthorized access.

    Information Storage and International Transfers

    We and our service providers process and store your Personal Data on servers around the world, including in the United States.

    Third Parties We Don't Own or Control

    Please note that this Privacy Policy does not apply to the practices of companies that we do not own or control or to people that we do not employ or manage. For example, if you download one of our applications on your smartphone, the manufacturer of your smartphone may have a policy that applies to its own practices for collecting information through that smartphone. We encourage you to read the privacy policies of each and every device, website, and service that you use.

    Changing or Deleting Your Information

    We will retain your Personal Data for as long as you maintain an account or as needed to provide you the services. If you are a registered user, you may review, update, correct or delete the Personal Data provided in your registration or account profile by changing your "account settings." If your Personal Data changes, or if you no longer desire our service, you may update or delete it by making the change on your account or by contacting privacy@myotest.com. We will also retain and use your Personal Data as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.  

    Our Policy Towards Children

    We do not knowingly collect Personal Data from children under 13. If you become aware that a child has provided us with Personal Data without parental consent, please contact us at privacy@myotest.com. If we become aware that a child under 13 has provided us with Personal Data without parental consent, we will take steps to remove the information and terminate the child's account.
